Philip T. Carroll joined Cozen O'Connor’s Chicago office in May 2006 as a Member practicing with the Subrogation and Recovery Department. Prior to joining the firm, Philip was a Member with Grotefeld & Denenberg, LLC in Bingham Farms, Mich.
He earned his undergraduate degree from the State University of New York at Stony Brook, and his law degree from the University of Detroit Mercy Law School.
Admitted to practice in Illinois and Michigan, Philip specializes in insurance law, specifically handling property subrogation claims.
Philip has lectured on various topics regarding subrogation, including Daubert expert challenges, spoliation of evidence, fire suppression system failures, and foreign service and collection. He is also extensively involved in the National Association of Subrogation Professionals ("NASP"). Philip served as the co-chair of the General Practice Section of NASP in 1995 and 1996, and as co-chair of NASP's Litigation Skills Conference in 2007. Currently, he serves on the Executive Committee for NASP's Litigation Skills Conference. He is also involved locally, serving as a committee member of the Michigan Chapter of NASP.
Philip's recent trial work included an aggregated subrogation action concerning flexible water connectors distributed by Robert Manufacturing under the name Bobflex Water Lines, which caused water damage to hundreds of homeowners. These connectors included a component part, supplied by CJC Enterprises d/b/a Hydr-O-Seal, which also was a defendant. This part was a barbed plastic insert which allegedly had failed inside the Bobflex line. Philip proceeded under the theory that the barbed insert had been made of improper material, causing it to suffer hydrolysis, degradation and eventual failure.
After almost four weeks of trial, the California jury found on behalf plaintiff's behalf on all counts, and against both defendants, including strict liability for design, manufacture and failure to warn, as well as negligence for failure to warn, design and manufacture. Robert Manufacturing was also found to have violated the California Legal Remedies Act, allowing for attorney fees.
Philip is also a member of the Advisory Board to the University of Detroit Mercy Law School.
