John R. Washlick, member in the Health Law Group, will be presenting Developing Defensive Strategies for Minimizing Manufacturer Liability When Physicians Utilize Products for Off-Label Purposes, at the American Conference Institute’s 7th National Forum on Off-Label Communications.
With several recent settlements by drug manufacturers, and the lawsuit filed by Allergan, Inc. against the U.S. Food and Drug Administration, which seeks a court ruling that the FDA may not ban the distribution of truthful information about off-label uses, this is currently one of the hottest topics in the life sciences and health care industries.
John will discuss how to determine a manufacturer’s liability when an off-label use causes injury, the legal risks associated with providing monetary incentive to a physician for off-label use of a product, and the monitoring of payments to professionals to determine if they are being compensated for off-label use.
