This program will focus on the amendments in the Patient Protection and Affordable Care Act (PPACA) to the Stark law prohibitions against physician self-referrals and new obligations under the PPACA for promptly reporting and repaying governmental program overpayments. The presenters will examine the interplay of these provisions with PPACA amendments of the federal False Claims Act -- creating new exposure for anyone doing business with the government or government contractors -- pertaining to "reverse false claims." The program also will cover the new Stark self-reporting disclosure protocol and rules for "compromising" liability for Stark law violations, as well as challenges that must be overcome under the Stark law for the funding of Electronic Health Records and establishment of Accountable Care Organizations.
