David Barron, a member of Cozen O’Connor’s Labor & Employment Department, discusses the potential legal troubles a company can run into by prohibiting employees from facial piercings. “The question becomes whether accommodating the employee would pose an undue hardship or whether there is some other form of compromise, like wearing a Band-Aid or covering the piercing,” said David, “Because these situations can be very subjective, it is important for employers to be as consistent as possible in dress code enforcement to avoid claims of favoritism or discrimination.”
