Overview
Cozen O’Connor’s Latin American subrogation and recovery practice is comprised of bilingual attorneys who handle subrogation and recovery claims throughout Latin America. Our experience ranges from the Northern tip of Mexico to the Southern tip of Argentina, and virtually all jurisdictions in-between. We are able to apply our 35-plus years of experience in addressing the subrogation aspects of large property and other first-party losses so as to maximize recoveries for the very same types of claims arising in Latin America. Our existing and expanding programs with a number of major U.S. and international insurers underwriting in Latin America have yielded substantial increases in their recovery amounts and ratios.
We are currently handling subrogation claims in every major Latin American jurisdiction. The claims range from complex petrochemical and industrial losses to more conventional fire or water damage claims. We work with a network of experienced forensic consultants in various Latin American jurisdictions, and have corresponding counsel relationships with boutique commercial litigation firms in these jurisdictions.
All of our work is performed on a contingent fee basis, so there never is any charge owing for our investigation, analysis, and prosecution of claims which do not produce a recovery to our clients. Moreover, by “partnering” on these claims with corresponding counsel in the applicable Latin American jurisdiction, our clients secure two firms for the price of one, since the work of Cozen O’Connor and our corresponding counsel is performed pursuant to Cozen O’Connor’s standard contingent fee agreements with our clients.
We have developed unique and creative approaches to short-circuit the otherwise time consuming litigation process in many Latin American jurisdictions, by moving aggressively to secure pre-litigation settlements, as well as utilization of mediation and arbitration proceedings. Our attorneys are distributed throughout a number of our U.S. offices, and are able to coordinate the subrogation investigation, analysis and pursuit of our clients’ claims on an extremely cost effective and highly efficient basis.
