Investigators from the local Fire Department in Canyon Lake, CA determined that a fire at an upscale health club originated in the building’s electrical room but they were unable to determine the ignition source. Investigators hired by Cozen O’Connor spent two days at the scene scouring the evidence, eventually placing the fire origin inside the electrical room wall. As that area was devoid of ignition sources under normal circumstances, the cause of the fire remained a mystery. The investigators confirmed there was an explosion on the distribution system of Southern California Edison (SCE) shortly before discovery of the fire and concluded that excessive ground fault current injected into the building from that explosion caused the fire. SCE’s investigators concluded that the explosion was the result, rather than cause, of the fire and made no settlement offers at mediation or a mandatory settlement conference. On the first day of trial, faced with the prospect of paying attorney’s fees and expert costs if we prevailed under the inverse condemnation theory, SCE settled the case for $1.5 million.
