Big data is changing the world. And its impact on litigation will be incredible. Although its influence is just beginning to be felt, Big Data will be a dominant feature in all types of litigation in the future. Big Data will be (and is) used to affect case outcomes, manage litigation dockets, conduct jury research, mediate and settle cases, choose forums, and to develop all aspects of case strategy. To be successful — now and in the future — litigators must understand the nature of big data — where it exists and how to access it, authenticate it, and get it admitted.
