ONC Discusses Health Data Risk from Entities Not Covered by HIPAA

Ryan Blaney, a member of Cozen O’Connor’s Health Care practice group and the Privacy, Data & Cybersecurity industry team, discusses a new report from the Office of the National Coordinator for Health Information Technology that examines privacy and cybersecurity risks for health care data not covered by HIPAA. Ryan says, “One major concern discussed throughout the report is that with the rapid growth of the mHealth industry, projected to be worth over $60 billion, organizations beyond the traditional health care organizations currently covered by HIPAA will fail to implement privacy and securities policies and safeguards.” Ryan also suspects that, “with the continued growth of health care IT, mHealth and mobile applications, state AGs and federal regulators will be pressured to increase the protection of individuals’ PHI even when it is shared outside of the reach of HIPAA.”
