Barry Klayman and Mark Felger, members of Cozen O’Connor’s Bankruptcy, Insolvency & Restructuring Practice Group, discuss in the Delaware Business Court Insider a recent case from the Delaware Superior Court dealing with the issue of an allegedly defamatory article that caused injury to a Delaware corporation hosted on a website outside of Delaware. The court held that it lacked personal jurisdiction over the nonresident author of the blog and the website host under the Delaware Long-Arm Statute because neither committed an act or omission within the state nor was there evidence that they regularly conducted business in the state.
