Megan Scheib, a member of Cozen O'Connor's White Collar Defense & Investigations Group, discussed with Law360 the trial of New York Governor Andrew Cuomo's former aide, Joseph Percoco. Percoco, whom prosecutors had accused of accepting hundreds of thousands of dollars in bribes in exchange for official favors to an energy company and a real estate developer, was convicted on one of two bribery counts he faced and on two honest services fraud counts. Defense attorneys say appeals courts may apply McDonnell more rigorously than juries, making reversals likely. “Juries don’t like hearing Supreme Court jurisprudence,” said Megan. “But the circuit courts of appeal are going to apply that law, and they’re going to kick it back.”
