David Reichenberg, a member in the firm's Commercial Litigation Department, was quoted in Law360's article, "California Cases To Watch In 2019." David discussed how Apple fights its latest epic IP war. In January 2017, just days after the Federal Trade Commission accused Qualcomm of using its dominance to wrangle higher royalties from cellphone makers and anti-competitive licensing terms for its standard-essential patents, Apple sued the chipmaker in California federal court alleging illegal business practices. David believes, “it could very well be that Qualcomm is saying, 'I have these patents that are enforceable and that are valid and I can bar products from coming into the U.S. rightfully under these patents. And then somebody else, like say an Apple, could say, 'But you failed to live up to your antitrust duty to license these on the terms that you agreed to license before a standard-setting body.'”
