Class Actions Group Files Amicus Brief in the Eleventh Circuit Related to Data Breach Class Action

Mike McTigue, Meredith Slawe, Becky Girolamo, and Max Kaplan of the Class Actions Practice Group filed an amicus brief in the 11th Circuit in support of Brinker International, the parent company of the Chili’s and Maggiano’s restaurant chains, on May 5, 2021.  Brinker is seeking to appeal an order in which Judge Corrigan of the Middle District of Florida rewrote the plaintiffs’ class definitions and then certified two classes.  Brinker has been defending this data breach putative class action, which now presents the company with more than $140 million in damages exposure for no-injury claims.  Our team, representing the Restaurant Law Center, National Retail Federation, and Retail Litigation Center, urged the 11th Circuit to take up the appeal.
