Defending Made-In-The-USA Claims

Brenden Coller and Richard Fama, of Cozen O'Connor's Commercial Litigation Department, co-authored, "Defending Made-In-The-USA Claims," for ASSEMBLY Magazine. The article addresses the "made-in-the-USA" claim and the importance of substantiation.  Under FTC guidelines, all significant parts and processing that go into a product are of domestic origin. The product should contain no or negligible foreign content.  A manufacturer making a Made-in-the-USA claim must have “competent and reliable evidence” to demonstrate that the product is all or virtually all made in the USA, including proof that its final assembly or processing occurred in the USA.
