Paul concludes that, "In handling a claim, insurers must avoid conduct giving the appearance that they are undertaking repairs, and should disclaim any undertaking in their communications with the insured. In some instances, however, the option to repair or replace could be an effective tool to resolve a claim, in which case an insurer must be mindful of a policy’s notice requirements."
