How A Court's 'Pencil Color' Impacts Restrictive Covenants

Christopher Hennessy, a member of the firm's Commercial Litigation Department, and Jeremy Glenn, a member of the firm's Labor & Employment Department, co-authored an article in Law360 Expert Analysis regarding restrictive covenants. They likened a state's approach to how the state is commonly perceived politically, i.e., "red" or "blue", and how the lack of a clearly perceived “color” to describe the state’s law actually creates ambiguity for employers and employees when it comes to drafting and enforcing restrictive covenant agreements. Illinois, the authors’ home jurisdiction, falls into that metaphorical "independent" middle ground, much like a number of other states across the nation, which presents a host of challenges for employers, employees, and their respective attorneys to consider.
