Terri Sutton authored "General Liability Insurance and the Opioid Epidemic" in the Winter 2018 issue of INSIGHTS: A Professional Journal by the CPCU Society. This article discusses the rising costs associated with the opioid epidemic, examining the varied success of coverage defenses that have been litigated while mentioning some that we can expect to see in the months and years to come. Specifically, this article dives into opioid usage, opioid lawsuits and coverage litigation to date. Two considerations are explored, including commercial general liability (CGL) policies cover only “Damages Because of ‘Bodily Injury’ and ‘Property Damage.'" and CGL policies cover only damages “Caused by an ‘Occurrence.’”
