Cozen O’Connor’s pesticides team has deep governmental and private sector experience and handles enforcement actions, import disputes, registration applications and procedures, pesticide device regulation, data compensation, antimicrobial and antiviral claims, and COVID-19 related responses connected to the use of EPA-registered disinfectants and sanitizers.

We have assisted clients in successfully resolving EPA investigations, inspections, import holds, and client self-disclosures covering a range of types of products and potential violations. We also work closely with clients pursuing pesticide registration with the EPA and the states, including label development, data submission, and data compensation.

Our team also provides consultation and witness support for registrants in state tort proceedings (e. g., pesticide poisoning allegations), in data compensation disputes, and in regulatory enforcement actions. We have authored comprehensive, fact-based materials for national companies developing protocols for system-wide use of registered disinfectants, and we have advised clients how to best manage the ongoing COVID-19 pandemic through integrated pest management systems. We have also advised clients on other pesticide use issues, including the use of pesticides in cannabis cultivation and the interface of EPA, FDA, and state regulatory protocols. 

Cozen O’Connor’s pesticides team includes four former EPA attorneys, including Peter Fontaine, who leads the practice, and Marcia Mulkey, the former director of the EPA’s pesticide program and the regional counsel of the EPA’s Region 3, which encompasses Pennsylvania, Delaware, West Virginia, Maryland, and Virginia.
