Jennifer Brandt, a member in the firm's Philadelphia office, appeared on the Fox News Network's Happening Now on May 23, 2011. Brandt discussed the "candy cane case" that was argued before the U.S. Court of Appeals for the 5th Circuit. The case concerns the scope of children's First Amendment protection, especially as it pertains to religion, in school. The children at the center of this case were giving out candy cane pens at a holiday party with the words “Jesus is the reason for this season.” The principal confiscated these pens. Brandt argued that, while children are protected by the First Amendment, the school district has a responsibility to protect the other children from proselytism.
