Nevertheless, recent trends in multiple jurisdictions have resulted in the “whittling down” of attorney-client privilege protections in the insurance litigation context, particularly in first-party insurance disputes. This presentation will provide a multijurisdictional review of such trends, as well as practical advice on how first-party insurers can best protect their attorney-client communications from discovery.
