With cooperation among the United States and foreign criminal and regulatory authorities related to the enforcement of anti-bribery laws on the rise, companies should take proactive measures to understand whether they are acquiring any FCPA issues in the course of a transaction and who may be liable for those issues. Companies should devise a sound strategy to mitigate risk associated with those issues, as well as protect against new issues that may arise.
