Irene Yesowitch and Greg Hudson, both of the Global Insurance Department, will present a webinar titled "Extracontractual Claims -- Recent Case Law and Trends" on Wednesday, April 15. This webinar highlights recent case law regarding bad faith in the insurance context. The webinar will examine situations in which bad faith claims have been asserted, and how the courts have dealt with those claims. The webinar will offer participants strategies to help avoid bad faith claims by improving claims handling, and identifying/resolving potentially difficult situations before they erupt into litigation.

The presenters will discuss:

  • Viability of a common or universal standard of liability
  • Aggressive good faith and prevention: mutually exclusive?
  • Bad Faith set-ups, including collusive settlements and judgments
  • Responding to policy limits demands
  • Liability for adjusters and other claims professionals
  • Moving beyond genuine dispute and reasonably debatable
    • Duties and rules applied to and imposed on policyholders
    • Reimagining and repurposing claimant tactics
    • Affirmative claims and defenses
