Roundtable 4: Navigating the AG Multistate Process: Investigation Response Strategies to Minimize Reputational Damage
Wednesday, September 20, 2023, 12:35 PM - 2:00 PM
One of the few things worse than being subpoenaed by a state attorney general is being subpoenaed by a coalition of state AGs working together and sharing resources to conduct a “multistate” investigation. A multistate action represents a serious threat to a company. A thoughtful and calculated response strategy needs to account for the unique nature of multistate investigations, which differ in critical ways from other investigations, as well as the individual AGs involved. A plan for responding to document requests, protecting confidential information, and negotiating a resolution, if possible, is also essential to minimizing reputational damage and avoiding outcomes that could require a company to fundamentally change its established business practices.
In this roundtable discussion, attendees will have a chance to interact with the leading state AG practice in the nation on:
The industries and types of businesses most likely to be investigated by state AGs
Recent significant actions and trends
Practical steps companies can take to avoid becoming the next target, and
What to do if the dreaded subpoena arrives.
