Lisa Ferrari and Keren Goldberger will discuss copyright concerns related to artificial intelligence and offer guidance for protecting intellectual property in AI projects. The emergence of ChatGPT has brought the world of AI to the forefront, highlighting the relevance and importance of this topic. Those using AI are facing uncharted waters when it comes to copyright issues. In-house counsel need to know how to advise their business on whether to develop, invest in, and use AI, and how to both protect the company’s rights in AI works and avoid infringement allegations when using AI. They will discuss the legal and commercial implications of denying versus allowing copyright registrations for AI-generated work and the potential infringement issues in using copyrighted works to both develop AI programs and generate AI outputs. They will also cover recent registration decisions and guidance from the Copyright Office in the area of AI; how the courts have approached AI and copyright issues to date; and what we can anticipate from the courts as they continue to tackle these emerging issues.
