Saturday, August 23, 2008

Cozen O’Connor members Deborah M. Minkoff and Lawrence D. Jackson recently participated in the Pennsylvania Bar Institute’s (PBI) “Claims Made and Professional Liability Insurance Coverage Seminars,” held in Pittsburgh on August 12 and Philadelphia on August 22. Minkoff moderated the seminar and delivered a presentation entitled, “Practical Issues in Enforcement of Claims Made Policies,” and Jackson’s presentation, “Whose Line Is It?”, dealt with the differences between professional and general liability risks. Seminar participants also learned how to compare coverage issues, gained insight into legal malpractice; discovered what constitutes proper notice under a claims made policy, and learned about employment liability coverage.

Resident in the Philadelphia office, Minkoff practices in the global insurance group, where she handles complex coverage litigation, with an emphasis on liability coverage issues. Minkoff represents clients in cases involving disputes under claims made liability coverages; disputes over the scope of professional liability coverage; primary and excess insurance disputes; advertising injury and personal injury coverages; claims invoking CGL policies' business risk exclusions; employment-related claims under CGL policies, and sexual harassment claims under both professional liability coverage and commercial liability coverage.

Minkoff has lectured on multiple insureds under liability policies and whether a good faith settlement terminate the duty to defend; the ensuing loss exception in first-party policies; bifurcation and trifurcation in bad faith litigation; employment-related claims under CGL policies; and effective legal writing. She is a member of the American Bar Association’s Tort and Insurance Practice Committee, and the Defense Research Institute (DRI). Named to the 2008 list of The Best Lawyers in America in the category of Insurance Law, Minkoff also served as a visiting professor at Villanova Law School in 2004, teaching statutory interpretation, case synthesis and legal writing.

Minkoff is a graduate of Franklin and Marshall College (A.B., 1981) and Villanova Law School (J.D., 1984), where she was a member of the Law Review and received the Pulling Award for outstanding student authorship.

A member in the Philadelphia office who practices in the global insurance group, Jackson is responsible for complex, multiparty insurance coverage litigation matters in state and federal courts. He also routinely advises insurers and serves as coverage and monitoring counsel in connection with exposures under various professional liability lines of coverage, including directors and officers, financial institution, investment advisor and mutual fund liability policies. His background also includes casualty defense and subrogation. Jackson has also lectured on issues involving directors’ and officers’ liability.

Jackson is admitted to practice in Pennsylvania, New York and New Jersey. He is a member of the American Bar Association and its Tort and Insurance Practice Section, the Pennsylvania Bar Association, the New Jersey Bar Association, the New York Bar Association, and the Maritime Law Association of the United States.
