Cozen O’Connor is pleased to announce that its intellectual property practice has successfully stopped infringement of key point-of-sale secure payment systems patents held by CardSoft (Assignment for the Benefit of Creditors), LLC. and won an award of $15,394,821.00 in damages for its client against VeriFone Systems, Inc. and VeriFone, Inc. (VeriFone) and Hypercom Corp. (Hypercom).
An Eastern District of Texas jury found that the payment terminal systems in dispute infringed on two CardSoft patents. The patents at issue include U.S. Patent No. 6,934,945 and U.S. Patent No. 7,302,683.
“We are pleased to have secured such a successful outcome for CardSoft,” said Donald R. McPhail, a Washington, D.C.-based member of Cozen O’Connor’s intellectual property practice. “The defendants in this case combined control the majority of the payment terminal market, including those devices used by most large U.S. retailers. This will create a significant shift in the point-of-sale market, and vindicates CardSoft’s four years fighting to protect its patents from unauthorized use.”
In addition to Mr. McPhail, Cardsoft was represented by Cozen O’Connor attorneys Kerry B. McTigue, Barry P. Golob, Andrew Nemiroff and Richard T. Ruzich, with support from Blake Coblentz and Aaron Lukas. Bo Davis, founding partner of The Davis Firm, P.C. in Longview, Texas, also represented CardSoft.
Cozen O’Connor is a full service law firm with 45 attorneys in its intellectual property practice. The attorneys service clients in all areas of intellectual property out of New York, Philadelphia, Washington, D.C., Chicago, and Atlanta.
