One notable aspect of the settlement is that it simultaneously resolves both domestic allegations based on the False Claims Act as well as allegations of separate international crimes with similar fact patterns. Such settlements that resolve factually separate but related investigations may become more common, Nicole told The FCPA Report. “The Department is trending toward resolution of as much legal exposure as it can in a single case at the time of settlement,” she said. This type of settlement “benefits the company as well as the Department,” she explained.
