Colorado Gov. Repeals Ban On Credit Card Surcharges

The State AG Group’s Bernard Nash and Keturah Taylor  have notched another win for client CardX, LLC. with Colorado Gov. Jared Polis signing into law SB 21-091 a measure repealing the state's prohibition on credit card surcharges, joining a wave of other states that have recently done the same. 

This win rounds out the trifecta, an AG opinion in Oklahoma declaring that its no-surcharge statute was unconstitutional, a federal judicial decision in Kansas declaring the same, and now the Colorado legislature repealing its no-surcharge ban and allowing surcharges with robust consumer protections.
