Nine Impacts of New Jersey and New Hampshire Privacy Laws

Ben Mishkin discusses the implications of the latest states to pass comprehensive privacy laws in Cybersecurity Law Report. The article addresses the unique aspects of New Jersey’s and New Hampshire’s laws, the 2024 privacy landscape, as well as steps to navigate the most recent obstacles in multistate privacy compliance. 

Ben discusses how the broad applicability of New Jersey’s law is similar to Colorado’s due to its minimal revenue threshold. However, the new law applies to companies with at least 100,000 data subjects or with a minimum of 25,000 consumers. He also looks at New Hampshire’s new law, which is the first to address conflicts between jurisdictions laws.

As companies consider how to approach multistate strategies, Ben suggests to “look at the state laws currently in effect and those coming into effect in the next six months” and determine their implications and address each law individually.
