Spoliation in Complex Litigation: Lessons Learned

Shelby Riney, of Cozen O'Connor's Commercial Litigation department, and Kara McCall published, "Spoliation in Complex Litigation: Lessons Learned," for the ABA's The Women of the Section. There has been an increase in sanctions awards related to discovery abuses, particularly in federal multidistrict litigation involving pharmaceuticals and medical devices. The article's cases illustrate several important issues relating to a defendant’s duty to preserve evidence, as well as measures a defendant can take to prevent a finding of spoliation.
