John Sullivan, a member of Cozen O’Connor’s Commercial Litigation Department, discusses the recent Cymbalta litigation in which the plaintiffs tried and failed to create an MDL. Plaintiffs filed cases in California and followed up with more filings in 23 states around the country, and then asked the Judicial Panel on Multidistrict Litigation to consolidate all of it for them. The JPML refused.
