Spoliation of evidence is a cause of action that may arise when someone destroys evidence relevant to a legal proceeding. Recently, the Illinois Appellate Court attempted to clarify the amount of time a plaintiff has to file a spoliation claim. However, the exact moment when that clocks starts ticking remains unclear.
