Josh is a seasoned antitrust litigator who represents clients in complex civil antitrust litigation, government investigations, and high-stakes commercial disputes. His practice encompasses a broad range of competition matters, including monopolization, conspiracy, unfair competition, merger challenges, and other restraints of trade. He regularly advises and advocates for clients in the technology, artificial intelligence, telecommunications, media, sports, and automotive sectors, among others.
Josh draws on significant public- and private-sector experience. Prior to joining private practice, he served as senior litigation counsel and trial attorney in the U.S. Department of Justice's Antitrust Division, where he was a member of the litigation and trial team in the landmark United States v. Google search monopolization case. During the 10-week trial, Josh examined and cross-examined key fact and expert witnesses. While at the DOJ, Josh also helped lead merger and conduct investigations involving the technology, media, and sports industries.
In private practice, Josh has represented plaintiffs and defendants in some of the nation's most significant antitrust matters. He represented a coalition of 34 state attorneys general in the jury trial against Live Nation/Ticketmaster, which resulted in a complete verdict for the government; two NASCAR Cup Series racing teams in a monopolization litigation and jury trial against NASCAR; and FuboTV in successfully challenging a proposed joint venture, following a five-day trial, in the sports streaming space.
Josh has handled all phases of litigation, from investigations and pleadings through discovery, motion practice, trial, and appeal. Earlier in his career, Josh clerked for Judge M. Margaret McKeown of the U.S. Court of Appeals for the Ninth Circuit.
Josh earned his J.D., summa cum laude from Georgetown University Law Center, where he was elected to the Order of the Coif, was awarded the George P. Mickum III Prize for the highest first-year GPA, and was the senior articles editor and on the senior board of The Georgetown Law Journal. Prior to entering the legal profession, Josh worked as a newspaper reporter, including covering state government and legislative matters. He earned his B.A., cum laude, from the University of Charleston.
