Daniel Harrington, a member of Cozen O'Connor's Subrogation & Recovery Department, will be presenting a CLE on "The Ethics of Asking for or Agreeing to Confidentiality or Non-Disparagement Provisions in Settlement Agreements" at the PBA Annual Meeting in Hershey, PA.
This presentation will explore how seemingly non-controversial confidentiality provisions in settlement agreements and stipulated protective orders can implicate the Rules of Professional Conduct, particularly those relating to improper restrictions on disclosure of relevant information and restrictions on the ability to practice law. These issues can affect lawyers who agree to such provisions as well as those who request them.
