Julie Trester and Jenny Goltz, members of Cozen O'Connor's Labor & Employment department, will be speaking at this event in Washington D.C.

Julie will lead a discussion on “The Latest on OFCCP’s Compensation Audits/Lawsuits.”  Drawing on her background in traditional labor law, Julie will explore how to prepare for and survive an OFCCP compensation audit, including:

  • Compensation analysis background – including the Ledbetter decision and the Ledbetter Act impact on compensation issues;
  • Required annual review of contractor compensation practices;
  • Compensation analysis before the audit - should you  try regression analysis?; and
  • Discussion of the effect of the Google decision on information requests. 

Jenny will lead a discussion on “Overview of Sexual Orientation and Gender Identity Employment Issues for Contractors.” Jenny will examine LGBTQ Rights Under Executive Order 11246 and Title VII, including:

  • EO 11246 and OFCCP enforcement of LGBTQ protections under Trump. Scaling back of reporting obligations;
  • EEOC position on applicability of Title VII to sexual orientation and gender identity;
  • Litigation in federal appellate courts over whether Title VII covers sexual orientation and gender identity;
  • Does the Circuit split make this issue ripe for SCOTUS review?; and
  • Transgender issues for federal contractors and other employers.
