Stephen Pate, of Cozen O'Connor's Global Insurance Department, will present on Bad Faith Litigation in the US at the LMA Academy. Bad faith litigation in the United States was once thought to be declining. In the past few years, major decisions in Texas, Florida and Federal Courts have revived extracontractual causes of action. This presentation will explain how public policy pressures have caused this and discuss the assault upon the 'Fairly Debatable' Standard, the new 'Five Rules' in Texas and a new attempt to introduce negligence as a cause of action.
