Although companies don’t have much leeway to control the speech of employees, HR and legal departments do have to watch out for political discussions that cross the line into harassing or discriminatory. “While employees certainly have the right to engage in political speech generally,” says Michael, “employers need to communicate with the workforce that their policies against harassment, discrimination and violence in the workplace apply to these types of discussions as well.”
