Mark Gallant, co-chair of Cozen O’Connor’s Health Care Practice Group, and Robert Chu, a member of Cozen O'Connor's Health Care Practice Group, are representing Wills Eye Hospital in its federal lawsuit seeking to overturn a U.S. Department of Health and Human Services decision that says Wills does not qualify as a hospital under Medicare. The complaint is the most recent step in a dispute that started in 2013. Wills argues that regulators at the Centers for Medicare and Medicaid Services made a decision that could prevent many high-profile hospitals from participating in Medicare if interpreted too broadly. The Philadelphia Inquirer quotes the lawsuit Mark and Robert filed which states the agency’s reading of the law “is not sustainable as a reasonable reading of the statute because it yields the absurd and incongruous result that most hospitals in the United States – including storied institutions such as the Cleveland Clinic – do not meet the Medicare Act’s definition of a hospital.”
