Daniel Johns was quoted in a Law360 article discussing how the National Labor Relations Board's (NLRB) newly solidified Republican majority may revisit several labor-friendly precedents established during the Biden administration.

Regarding the NLRB’s 2023 Stericycle decision, which replaced the Boeing standard for evaluating employer handbook rules, Dan stated that employers have found the framework frustrating because it restricts workplace policies without considering the employer's reasons for implementing them.

Enforcement of Stericycle has already eased under Republican leadership, but Dan explained that many employers are hoping the standard will be removed altogether. Dan stated “I think a lot of employers are looking at Stericycle and hoping there's a return to that Boeing standard, where things could be found illegal, but the employer had at least a chance to justify what it was doing, and in many instances had good reasons.”
