The End Of Overtime Pay As We Know It? [Law360]

Michael Schmidt, vice chair of Cozen O'Connor's Labor & Employment Department, discusses the end of overtime pay in Law360. After years of debate and prognostication, the U.S. Department of Labor last year issued a proposed new overtime rule that increased the minimum salary threshold for the white collar exemptions, only to then have a Texas federal judge grant a nationwide injunction on November 22, 2016, to prevent the DOL from implementing its new rule. That decision is currently being appealed and it is not yet known how the Trump administration will attempt to defend that proposed new rule (if it does) when its appeal brief is due on June 30, 2017.
