Who Pays for Repairs? Check the Condo Bylaws

Leni Morrison Cummins and Jennifer Miller co-authored an article published in Habitat Magazine addressing the circumstances under which a condominium board may be held responsible for the cost of repairs to a unit. The key question, the authors explain, often is whether the triggering event that caused the damage meets the definition of “casualty.” That analysis is critical, because if the triggering event is considered a casualty, the cost of repairs typically shifts to the condominium.
