News - Subrogation & Recovery
Joe Rich, a member of the Subrogation & Recovery Department, passed the Federal Bar Examination for the United States District Court for the District of Puerto Rico. Unlike most federal courts that allow admission without an examination, the District of Puerto Rico requires applicants to sit for a multiple choice and essay examination covering topics of Federal Civil and Criminal Procedure, Federal Sentencing, Evidence, Jurisdiction and Venue, Appellate Procedure, Ethics, and the Bankruptcy Code. Congratulations to Joe---only 30% of the attorneys who took the exam passed.

A settlement is a settlement. The parties agree on its terms, terminate the litigation, and move on. Right? Not always. Class actions, for example, are different. There, the courts must review the settlement to determine whether it is fair and reasonable. If it is not, the court may reject the settlement and require the parties to craft different settlement terms or resume litigation.

The list, published in May 2013, ranks firms and individuals according to the number of U.S. trademark registrations issued in 2012.

The process of serving foreign defendants can be a long and costly path through the Central Authority or courts of a foreign country under The Hague Convention (on the Service Abroad of Judicial and Extrajudicial Documents), and sometimes the requests for service go unanswered for several months, leaving litigants to wonder whether they will ever be able to pursue their case.

At oral argument in Association for Molecular Pathology v. Myriad Genetics, the U.S. Supreme Court recently grappled with the question of whether human genes are patentable. Justice Stephen Breyer seemed to capture the justices' sentiment in the lively argument session: "The patent law is filled with uneasy compromises." The compromises that the justices choose will affect the future work of the U.S. Patent and Trademark Office (PTO) and shape the path of genetic research in the future.

Jason Beckerman and Ryan Kearney of the New York Downtown office published an article in The New York Law Journal titled, “Accountability in Elevated Construction Accidents,” which discusses the traction to reform New York’s well-known scaffolding statute embodied in Labor Law § 240(1). Over the past two decades the law has evolved into a windfall for a small group of plaintiff’s attorneys, while simultaneously causing construction insurance premiums to skyrocket. With increased insurance costs real estate development in and around New York City has become limited, causing major developers to look to other states for development sites.
