Joe Rich, a member of the Subrogation & Recovery Department, passed the Federal Bar Examination for the United States District Court for the District of Puerto Rico. Unlike most federal courts that allow admission without an examination, the District of Puerto Rico requires applicants to sit for a multiple choice and essay examination covering topics of Federal Civil and Criminal Procedure, Federal Sentencing, Evidence, Jurisdiction and Venue, Appellate Procedure, Ethics, and the Bankruptcy Code. Congratulations to Joe---only 30% of the attorneys who took the exam passed.

There, the courts must review the settlement to determine whether it is fair and reasonable. If it is not, the court may reject the settlement and require the parties to craft different settlement terms or resume litigation.

Jason Beckerman and Ryan Kearney of the New York Downtown office published an article in The New York Law Journal titled, “Accountability in Elevated Construction Accidents,” which discusses the traction to reform New York’s well-known scaffolding statute embodied in Labor Law § 240(1). Over the past two decades the law has evolved into a windfall for a small group of plaintiff’s attorneys, while simultaneously causing construction insurance premiums to skyrocket. With increased insurance costs real estate development in and around New York City has become limited, causing major developers to look to other states for development sites.
