Stephen Pate and Alycen Moss, of Cozen O'Connor's Global Insurance department, will present at the 2018 Windstorm Insurance Network Conference. Stephen will present on the topic, "Open the Floodgates: Is It Wind or Flood?" and Alycen will present on the topic "Concurrent Cause Conundrum." The breakout session "Open the Floodgates: Is it Wind or Flood?" will help separate damage to structures due to storm wind from damages cause by flood. The presentation will discuss how buildings respond to wind force and how structures respond to rising water. The breakout session "Concurrent Cause Conundrum" will cover recently revisited application of the "efficient proximate cause" doctrine to determine the burden of proof for application of exclusionary language in property insurance policies. The presentation will discuss the underlying tenets of each standard of proof, and comment on industry and policyholder approaches to proving and avoiding exclusions in standard form commercial property policies.
