OSHA’s newly issued COVID-19 guidelines make clear that employers must apply different safety standards to unvaccinated and vaccinated workers. Having two sets of rules in the workplace creates significant legal and practical challenges, which will be the subject of this webinar. Topics to be discussed include:

  • Overview of recently issued OSHA Emergency Temporary Standard for health care workers and COVID-19 guidelines for all other employers
  • Legal obligation under state and federal law to investigate employee vaccination status for purposes of enforcing continued COVID safety protocols
  • Potential legal risk for employers who choose to undertake an “honor system” approach for compliance by unvaccinated workers
  • Update on mandatory vaccination policies, and recently filed lawsuits challenging such policies
