In an article titled "Abercrombie Case Leaves Companies in Dark on Dress Codes," David Barron, a member of Cozen O’Connor’s Labor & Employment Department, discusses how employers can enforce dress code policies while avoiding litigation. “The employer’s position will be much stronger if it has a documented and consistently applied policy already in place, absent such a policy, the EEOC or court may wonder whether the issue is really as important as claimed by the employer,” says David.
