Nationally, the EB-5 program has been plagued with allegations of abuse including fraud, Securities Exchange Commission violations, preferential treatment, and manipulation of census tract selections so that projects in affluent areas can appear to qualify as low-employment areas. "These are reactions to a history of abuses," said Scott. "It's absolutely necessary. It will definitely shed the marginal players in the field."
