PA Ruling Won't Lower Bar To Prove Insurer Bad Faith [Law360]

Stephen Pate and Abby Sher, of Cozen O'Connor's Global Insurance department, were quoted in an article for Law360 titled, "Pa. Ruling Won't Lower Bar To Prove Insurer Bad Faith." The article discusses a unanimous ruling where Pennsylvania justices affirmed a decision by the state's Superior Court that an insurance carrier's motive of self-interest or ill will is merely one factor that may be considered in an analysis of potential bad faith conduct. In the article Stephen discusses bad faith and is quoted saying, "I say it is unworkable because a trial court will have a to struggle to define the different factors and decide how important the intent factor should be." Abby is quoted saying, "The court confirmed that a rigorous standard for bad faith liability is the law in Pennsylvania, and mere negligence will not suffice." For the full article, click here.
