David Barron spoke with Fortune about the rights that furloughed employees have. Furloughed workers are still technically employed and protected by discrimination laws. "If they start to recall employees, they couldn't do it in a discriminatory way ... you can't bring all the men back first," said David. But again, there is no law requiring employers to rehire furloughed workers.
