Nadine Menendez was sentenced in September to four and a half years in prison following her conviction at trial for taking bribes in exchange for arranging political favors from her husband and former U.S. Senator Bob Menendez. In a reply brief in support of her motion for bail pending appeal, filed yesterday, Mrs. Menendez told a New York federal court that “the government refuses to look into the mirror and acknowledge any missteps” that its conduct stemming from a 2023 attorney proffer violated her Sixth Amendment rights and raises the "substantial question" requiring her release as she appeals her conviction.
Sarah Krissoff, a member in the White Collar Defense & Investigations group and counsel for Mrs. Menendez, said that resolution of the issue is important not only to her client, “but to the federal criminal justice system more broadly. The potential for abuse should the government's conduct be allowed to stand is enormous."
