Charles (Chuck) Jesuit of the Global Insurance Department is quoted in a Law360 article titled "Bad Faith Suits Poised To Rise After Pa. Assignment Ruling." He discusses the ruling in Allstate v. Wolfe that policy holders can assign claims under a state bad faith insurance law to third-party claimants. Chuck says this decision “gives third-party claimants and their counsel another arrow in their quiver when negotiating settlement,” however; Chuck does not think the decision will significantly affect insurers’ behaviors.

Jennifer Brandt, a member of the firm’s Family Law Group, was on the Fox News Network today to discuss the Connecticut teen who is being forced to undergo chemotherapy. The 17-year-old girl previously refused the treatment for her cancer, was removed from her home, and is now in state custody. The case is scheduled to go before the Connecticut Supreme Court this week.

Cozen O’Connor has prevailed in a major victory in the Pennsylvania Supreme Court, after hearing arguments from Stephen Cozen, ruled that the legal expenses racked up in fighting a mayoral ballot challenge were not incurred to influence the outcome of an election and could be forgiven. Cozen O’Connor has been fighting for seven years to forgive the full amount owed by U.S. Representative Bob Brady’s campaign committee.

In an article titled “EEOC Targets Wellness Programs,” Debra Friedman, a member of Cozen O’Connor’s Labor & Employment Department, discusses the Equal Employment Opportunity Commission’s recent actions against employers for violating the Americans with Disabilities Act (ADA) and Genetic Information Nondiscrimination Act (GINA) with their company wellness programs. “The EEOC describes it as ‘you can’t penalize employees,’ but they have not defined what constitutes a penalty,” observed Debra. “Employers need to understand this is an evolving area, and there’s a lack of guidance from the EEOC, so we need to wait and see whether EEOC and courts will find wellness programs that are compliant with the ACA regulations to be compliant with ADA and GINA,” she added.
