Pennsylvania Superior Court Confirms CGL Insurers Owe No Duty to Defend or Indemnify Homebuilders Against Construction Defect Claims - Insurance Coverage Alert! - On December 28, 2007, Cozen O’Connor attorneys scored another important victory for insurers in Pennsylvania. In a carefully-reasoned, precedential opinion, a panel of the Superior Court unanimously confirmed that an insurer has no duty to defend or indemnify a builder under a CGL policy for water intrusion damage to a home due to faulty workmanship.

Houston Court of Appeals Holds That Post-Injury Arbitration Agreement Was Not Exempted From FAA or Invalid Under FELA - Maritime Alert! - 3 pgs total. Recognizing that mandamus review is an extraordinary remedy that will issue only to correct a clear abuse of discretion when the abuse cannot be remedied by appeal, the court held that a party has no remedy for wrongful denial of its right to arbitrate under an agreement subject to the Federal Arbitration Act (“FAA”).

Each year, the NLJ recognizes the lawyers and law firms that have worked to ensure that legal rights are not contingent on an individual's ability to pay for an attorney. The award committee looks for the firms and individuals who made the biggest commitments, both in time and in money on behalf of pro bono clients. Cozen O'Connor was recognized for the firm's work as lead private counsel in the Hazleton, Pa., immigration case that captured national attention last year.

He concentrates his practice in business litigation, business torts, complex insurance coverage and professional responsibility matters.
